An Auckland farmer pleaded guilty for breaches of health and safety standards, which resulted in the death of an employee. The farmer was appropriately fined.
The New Zealand Police now want a second bite of the cherry and deem the business operating illegally during the period of the OHS breaches.
The failings meant that the business was operating outside the law.
They are pursuing the farmer for receiving revenue/income during the breach period as ‘Proceeds of Crime’.
That is the depth of thinking of the NZ police.
Can we wind back and pursue businesses here for receiving ‘Proceeds of Crime’ for the period they operated outside of law?
Some examples that come to mind are businesses not accounting for VAT (value added tax), overcharging customers, breach of
OHS regulations and so on.
Believe me, if we take this approach, we will have lots of revenue coming in and iron out the crooks.
